1. Acceptance of Terms, Scope & Sales Channels

These Terms govern all purchases, services, and interactions with YARE ("we," "us," or "our"), operating online at https://tezayarena.studio.

Off-Site & Direct Sales: These Terms legally bind all orders placed under the YARE brand, whether initiated on the website, via social media channels (e.g., Instagram DMs, WhatsApp messaging), direct telephone orders, or manual off-site transactions.

You must be at least 18 years old, or have permission from a parent or legal guardian, to create an account, initiate direct communications, or place an order.

2. Device Permissions, Virtual Try-On & Acceptable Use

Certain interactive features request temporary access to device hardware. Permission is requested by your browser or operating system only when triggered:

  • Camera & Image Access: Used for Virtual Try-On previews powered by Decart AI, visual fit references, or uploading return verification photos. Submitting photos or enabling camera streams is strictly voluntary and initiated solely by you.
  • Location: Used to estimate local dispatch fees and direct pickup choices.
  • Microphone: Used solely for user-initiated voice search.

Third-Party Processing & User Warranties: Virtual try-on outputs are processed via Decart AI (anywear.js). By using the Virtual Try-On tool, you represent and warrant that you hold all necessary rights, permissions, and consents for any photo or image input provided. You must not upload non-consensual imagery, media depicting minors without legal parental authorization, or content that violates third-party copyright or publicity rights.

Prohibited AI Usage: You are strictly prohibited from utilizing the Virtual Try-On engine for biometric tracking, facial identification, emotion surveillance, deepfake creation, or generating hateful, abusive, or harmful imagery.

3. Account Security & Cancellation

You are responsible for maintaining the confidentiality of your account credentials and for all activities conducted under your account.

We reserve the right to suspend or terminate accounts involved in fraudulent activity, abusive behavior, security manipulation, or policy violations without prior notice.

4. Product Pricing, Virtual Try-On Disclaimers & Logbook Archives

Product descriptions, photography, sizing, regular prices, and sale prices are provided in good faith. Minor color or texture variations may occur due to screen settings or production lots.

AI Output & Sizing Disclaimer: Virtual Try-On visualizations are generated using probabilistic machine learning models. Renders are intended solely as visual, stylistic approximations for reference and do not guarantee exact fabric drape, physical fit, stretch, or color accuracy on individual body types. Customers remain solely responsible for evaluating size charts and garment specifications prior to placing an order.

Logbook & Archives: Select items featured in our Logbook or Archive collections are displayed strictly for historical or editorial purposes and may not be available for immediate purchase.

We reserve the right to correct typographical pricing errors, modify regular or promotional prices, limit quantity allocations, and cancel affected orders where product information was materially inaccurate.

5. Payment Methods, Mobile Money & Gateways

Supported Payment Scope: Electronic payments are processed via authorized financial processors and licensed Electronic Money Issuers. Mobile Money (MoMo) is currently our primary enabled payment method across standard web checkout and direct messaging routes.

Debit/credit card payments and bank transfers are actively being integrated and will be supported as checkout options become enabled on our platform. Until formally activated at checkout, we accept no responsibility for failed orders, delayed confirmations, or third-party bank fees caused by attempts to submit funds via unsupported payment routes or unauthorized manual wire transfers.

Gift Cards: YARE Gift Cards represent non-refundable digital store credit and cannot be exchanged for cash. You are solely responsible for securing your unique gift card redemption code.

6. Shipping, Local Courier Dispatch & Risk of Loss

Fulfillment options include local motorcycle or vehicle dispatchers (such as Bolt, Uber, or local couriers) and direct in-store pickup options chosen during checkout or off-site order arrangement.

Estimated delivery timelines are approximations and may fluctuate due to traffic conditions, weather events, or courier availability outside our reasonable control.

Risk of loss or damage passes to you upon courier handoff or completion of pickup at our designated fulfillment location.

7. International Orders, Customs Duties & Taxes

If you access our website or order items from outside Ghana, you are responsible for ensuring compliance with your local import and consumer regulations.

International shipments may incur foreign customs duties, import tariffs, value-added taxes (VAT), or clearance fees levied by destination border authorities. All such additional costs are the buyer's sole responsibility and are non-refundable by YARE.

8. Size Exchanges, Fitting & Returns

Size Exchanges: Finding the right fit is essential. When your order arrives, you are expected to try on the items to verify that the size is correct. If the item does not fit as expected or if the wrong size was delivered, you may request a size exchange (subject to stock availability) within 7 days of delivery or pickup fulfillment.

Fitting Eligibility: To remain eligible for a size swap or return after trying on your purchase, garments must remain unwashed, unaltered, free from damage, stains, perfumes, or deodorant marks, and returned with original tags and packaging intact.

Exchange Logistics: Courier dispatch fees for size exchanges or returns are the customer’s responsibility unless the wrong size or a defective item was fulfilled by YARE. Order cancellation requests are accepted only if the order has not yet entered processing or courier dispatch.

9. Intellectual Property, AI Metadata & Provenance

All digital assets, logos, brand photography, garment designs, product text, codebases, and media assets on this site are the exclusive property of or licensed to YARE. Re-use, distribution, or commercial reproduction without prior written consent is strictly prohibited.

Metadata & Watermark Integrity: Subject to compliance with these Terms, you retain personal evaluation rights to your try-on renders. You agree not to strip, remove, obfuscate, or alter any machine-readable watermarks, labels, or provenance metadata embedded within AI try-on outputs.

10. Limitation of Liability

To the maximum extent permitted by applicable law, YARE is not liable for indirect, incidental, special, or consequential damages. Our total liability for any claim arising from a purchase is limited to the actual amount paid for the order in question.

11. Governing Law & Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Republic of Ghana (including the Electronic Transactions Act, 2008). Disputes shall be submitted to the exclusive jurisdiction of competent Ghanaian courts, without prejudice to non-waivable statutory rights held by international consumers in their home jurisdictions.
